These Terms and Conditions ("Terms") govern your use of the website located at [nocopsw.com] (the "Site") and the exterior cleaning services ("Services") provided by Noco Pressure & Softwash ("Noco PSW," "we," "us," or "our"). By using the Site, requesting a quote, or scheduling Services, you ("you," "Client," or "Customer") agree to these Terms. If you do not agree, do not use the Site or our Services.

These Terms incorporate by reference our [Privacy Policy], [Refund & Satisfaction Policy], and [Accessibility Statement].

1. About Us

Noco Pressure & Softwash is a mobile exterior cleaning business based in [Windsor, Colorado], serving residential and commercial customers in [Greeley, Fort Collins, Loveland, Windsor], and surrounding Northern Colorado areas. We operate without a physical storefront. All Services are scheduled and performed at the Client's property or another agreed-upon location.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Site or request Services. By submitting a quote request, you represent that you meet this requirement and that any property information you provide is accurate.

You must also have legal authority over the property where Services are to be performed, or have written permission from the property owner. We may request verification of authority before performing Services.

3. Services Offered

We currently provide the following exterior cleaning Services:

  • Driveways, sidewalks, and concrete flatwork

  • Patios and pool decks

  • Fences and wooden decks

  • Commercial flatwork

We do not currently offer:

  • House washing or siding cleaning

  • Roof cleaning

  • Window cleaning

  • Gutter cleaning

  • Any service not expressly listed in your written quote

The list of Services we offer may change. The Services included in any specific job are limited to those itemized in your written quote or invoice.

4. Quotes and Estimates

4.1 Quote Validity

All quotes are estimates based on information you provide and, where applicable, photographs or a site visit. Quotes are valid for [30] days from the date issued unless otherwise stated.

4.2 Adjustments

We reserve the right to adjust a quote if conditions at the property differ materially from what was represented at the time of quoting. This includes, without limitation: square footage discrepancies, severe staining or biological growth requiring additional treatment, hazardous conditions, restricted access, or surfaces not disclosed during the quoting process. We will notify you of any adjustment before performing additional work and obtain your approval.

4.3 No Obligation

A quote is not a binding contract until both parties confirm scheduling in writing (including email or text message) and any required deposit is received.

5. Scheduling, Cancellation, and Weather

5.1 Scheduling

Service appointments are scheduled in advance and confirmed by email or text. You are responsible for ensuring the property is ready for Services on the scheduled date.

5.2 Customer Cancellation

Cancellation and rescheduling terms are set out in our [Refund & Satisfaction Policy]. In summary, cancellations made with adequate notice may avoid fees; late cancellations or no-shows may result in a fee.

5.3 Weather Rescheduling

Pressure washing and soft washing depend on weather conditions. We reserve the right to reschedule Services for safety or quality reasons due to rain, freezing temperatures, high winds, lightning, or other unsuitable conditions. We will provide as much notice as practical and will work with you to find an alternate date.

5.4 Right to Refuse Service

We may decline or discontinue Services at our sole discretion if conditions at the property are unsafe, if surfaces appear unsuitable for cleaning, if we cannot perform the work to professional standards, or if behavior at the site is abusive or threatening.

6. Customer Responsibilities

To allow us to safely and effectively perform Services, you agree to:

  • Provide access to the property and to a working outdoor water source unless otherwise arranged.

  • Move vehicles, grills, planters, decor, toys, and personal items from the work area before our arrival.

  • Secure pets indoors for the duration of the Services.

  • Close all windows, doors, and exterior openings in or near the work area.

  • Disclose any pre-existing damage, fragile surfaces, recent repairs, sealed or coated surfaces, loose mortar, lead paint, asbestos, or other conditions that may affect the work.

  • Identify any plants, landscaping features, or surfaces requiring special protection.

  • Notify us of any electrical hazards, exposed wiring, low-voltage lighting, irrigation components, or similar items in the work area.

If you fail to meet these responsibilities and we incur additional time, materials, or risk as a result, we may adjust the quote or reschedule.

7. Property Condition and Pre-Existing Damage

Exterior surfaces age, weather, and degrade over time. Pressure washing and soft washing reveal — and in some cases dislodge — material that was already weakened, loose, or compromised before our arrival.

You acknowledge and agree that we are not responsible for:

  • Damage to surfaces that were already cracked, spalled, pitted, oxidized, weathered, rotted, or otherwise deteriorated.

  • Loose paint, stain, sealer, or coatings that wash off because they had failed adhesion before service.

  • Loose mortar, grout, or caulk that releases during cleaning.

  • Failed or improperly installed sealants, gaskets, or weatherproofing.

  • Window screens, light fixtures, or trim that detach due to age or improper installation.

  • Damage caused by undisclosed conditions or by your failure to follow Section 6.

We perform Services using standard industry practices and equipment appropriate for the surface. We are responsible for damage we directly cause through negligence in our work, subject to the limitations in Section 11.

8. Chemicals and Methods

We use professional-grade cleaning solutions, including sodium hypochlorite-based mixes, surfactants, degreasers, and specialty products, applied at industry-standard dilutions. We take reasonable steps to protect surrounding plants, landscaping, and property by pre-rinsing, neutralizing, and post-rinsing as appropriate.

You acknowledge that:

  • Sensitive plants, fresh sod, or recently treated lawns may show temporary stress despite our precautions.

  • Color variation between cleaned and uncleaned sections of a surface is normal.

  • Some staining (rust, tannin, oil, efflorescence, atmospheric staining, mineral deposits) may require specialty treatments and may not be fully removable in a single visit.

  • Soft washing biological growth (mold, algae, mildew) does not prevent regrowth, which depends on factors outside our control such as moisture, shade, and tree cover.

9. Payment Terms

9.1 Payment Methods

Accepted payment methods will be communicated at the time of scheduling. Payment is due upon completion of Services unless otherwise agreed in writing.

9.2 Deposits

For larger jobs or commercial work, we may require a deposit to hold a scheduled date. Deposit terms are addressed in the [Refund & Satisfaction Policy].

9.3 Late Payment

Invoices not paid within [15] days of the due date may incur a late fee of [1.5%] per month or the maximum allowed by Colorado law, whichever is less. We may suspend future Services for accounts in arrears.

9.4 Returned Payments

You agree to reimburse us for any fees we incur due to returned checks or chargebacks initiated without first attempting good-faith resolution under our [Refund & Satisfaction Policy].

9.5 Disputes

If you have a concern with completed work, contact us within the timeframe set out in the [Refund & Satisfaction Policy] so we can address it. Initiating a chargeback in lieu of contacting us first is a breach of these Terms.

10. Refunds and Satisfaction Guarantee

Refund eligibility, re-service rights, and dispute procedures are governed by our [Refund & Satisfaction Policy], which is incorporated into these Terms.

11. Limitation of Liability

To the maximum extent permitted by Colorado law:

  • Our total liability for any claim arising from or related to the Services or the Site is limited to the amount you paid us for the specific Service giving rise to the claim.

  • We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of use, loss of business, or property devaluation.

  • We are not liable for damage caused by your failure to disclose pre-existing conditions, failure to follow Section 6, or failure to follow post-service care recommendations.

  • Some jurisdictions do not allow certain limitations of liability, and to that extent these limitations may not apply to you.

Nothing in this Section limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

12. Insurance

We carry general liability insurance covering our exterior cleaning operations. A certificate of insurance is available on request for commercial clients or property managers requiring documentation. Our insurance does not cover damage excluded under Section 7 or losses outside the scope of our policy.

13. Photography and Marketing Release

Unless you opt out in writing before Services are performed, you grant us a non-exclusive, royalty-free, perpetual license to use photographs and videos of the work area — taken before, during, and after Services — for marketing and portfolio purposes, including on our Site, social media, advertising materials, Google Business Profile, and printed marketing.

We will not include identifying information about you or your property (name, address, license plates, identifiable interior views) without your separate written consent. You may opt out of marketing use by emailing us at [Business Email] before the day of Service.

14. Website Use

14.1 Permitted Use

You may use the Site for lawful purposes only — to learn about our Services, request a quote, contact us, or otherwise engage with our business. You agree not to:

  • Use the Site in any way that violates applicable law or regulation.

  • Interfere with the Site's operation or security.

  • Use automated systems (bots, scrapers, crawlers) to access the Site except as permitted by our robots.txt file.

  • Attempt to gain unauthorized access to any portion of the Site, our systems, or related infrastructure.

  • Submit false, misleading, or fraudulent information through any form on the Site.

14.2 Forms and Submissions

When you submit information through a contact form, quote request, or other form on the Site, you represent that the information is accurate and that you are authorized to provide it. We handle submitted information in accordance with our [Privacy Policy].

The Site may contain links to third-party websites for convenience. We do not control and are not responsible for the content, privacy practices, or terms of any third-party site.

15. Intellectual Property

You may not use our name, logo, or any photographs of our work in your own marketing or commercial materials without written permission.

16. Disclaimers

THE SITE AND THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EXCEPT FOR THE LIMITED RE-SERVICE REMEDY DESCRIBED IN OUR [REFUND & SATISFACTION POLICY], AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not warrant that cleaning results will meet any specific standard beyond those described in our published service descriptions, and we make no guarantee against future regrowth, restaining, or weathering.

17. Indemnification

You agree to indemnify, defend, and hold harmless Noco Pressure & Softwash, its owner, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your breach of these Terms.

  • Your violation of any law or third-party right.

  • Your failure to disclose pre-existing conditions or to follow customer responsibilities under Section 6.

  • Inaccurate information you provided about the property or the work to be performed.

  • Claims by a third party (such as a property co-owner or HOA) that you lacked authority to authorize Services.

18. Force Majeure

We are not liable for any delay or failure to perform Services caused by circumstances beyond our reasonable control, including severe weather, natural disasters, public health emergencies, fire, flood, equipment failure, supply chain disruption, government action, civil unrest, or labor disputes. We will use reasonable efforts to reschedule affected Services.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in [Weld County, Colorado], and you consent to the personal jurisdiction of those courts.

20. Dispute Resolution

Before filing any legal action, both parties agree to attempt to resolve disputes in good faith by contacting the other party in writing and allowing [30] days to attempt resolution. This requirement does not apply to claims for injunctive relief or to chargeback disputes initiated through a payment processor.

21. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect, and the invalid provision will be reformed to the minimum extent necessary to make it enforceable while preserving its intent.

22. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later. Any waiver must be in writing and signed by us to be effective.

23. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms to a successor business in connection with a merger, acquisition, sale of assets, or similar transaction.

24. Entire Agreement

These Terms, together with our [Privacy Policy], [Refund & Satisfaction Policy], [Accessibility Statement], and any written quote or service agreement, constitute the entire agreement between you and Noco Pressure & Softwash regarding your use of the Site and our Services, and supersede any prior or contemporaneous communications.

25. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this document reflects the most recent revision. Continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms. For material changes affecting Services already scheduled, we will notify affected Clients directly.
